Subha Mohan joined Curtis in September 2007 as an associate in the Firm’s Oman office. Prior to joining the Firm, Ms. Mohan was an associate at a leading local law firm in Muscat and an advocate at the High Court of Madras.
She has wide experience in advising on a variety of commercial and legal transactions, including, banking, energy, derivatives, environment, employment, telecommunication, commercial agency, insurance, international arbitration, construction, privatization, tourism development, real estate and incorporation of different forms of commercial vehicles.
She has been closely associated with the following:
- a Refinery Project - acting as local counsel for a consortium of lenders included advising on local laws, Facility Agreements and creation of security interests;
- a gas transportation company in relation to:
- dispute with the Supervisory Control And Data Acquisition (SCADA) EPC contractor involving intricate technical issues;
- refinancing of the existing credit facilities;
- payment of acceleration charges to the EPC contractor;
- dispute with the operator of the Company’s gas transportation facilities.
- a power and water procurement company in relation to:
- dispute with a power company on the payment of capacity charges;
- dispute with a power company in respect of claims arising prior to the Commercial Operation Date;
- standardising the tender documents;
- merger of two refineries in Oman;
- a leading LNG company on various commercial and corporate issues;
- a successor company in the electricity sector in relation to:
- review of various sale and purchase contracts entered before privatisation;
- dispute with an oil marketing company;
- corporate compliance of the holding company and the successor companies in the electricity sector;
- a power company in refinancing of existing credit facilities and in respect of other commercial and corporate issues;
- a refinery company on various commercial and corporate issues;
- a consortium of lenders on refinancing of a major tourism project;
- various banks on local law issues in respect of derivatives transactions;
- a local bank on mortgages and their registration with the relevant authorities;
- a leading international insurance company on local law issues with respect to a reinsurance dispute;
- the Ministry of Tourism and a major tourism company on Development Agreements for tourism projects in Integrated Tourist Complexes;
- a multinational company in respect of arbitration;
- a multinational software company in relation to incorporation of a local entity in Oman and visa and employment issues;
- preparation of the law digest on Omani laws for Martindale-Hubbell; and
- incorporation of the following companies:
a. a closed joint stock company having the concession to build, own and operate the first private desalination plant in the country;
b. a limited liability company for the management and operation of the first private desalination plant;
c. a limited liability company in the oil sector;
d. a limited liability company for carrying out telecommunications projects in Oman;
e. the first company in the Gulf region for Tier II crude oil spill response;
f. a closed joint stock company for operating an FM radio station in Oman;
g. a limited liability company in the tourism sector;
