Mr. Fleming is head of the Litigation Department. He joined the Firm in 1970. That same year he served as Special Counsel for the Select Committee on Crime of the House of Representatives. Previously, Mr. Fleming was an Assistant U.S. Attorney, Southern District of New York, and then Executive Assistant to the U.S. Attorney, Southern District of New York, Robert Morgenthau.
In 1992 he was appointed Temporary Special Independent Counsel to Senators Mitchell and Dole, the majority and minority leaders, to investigate the unauthorized dissemination of confidential information during the hearing on the nomination of Clarence Thomas as Associate Justice of the U.S. Supreme Court.
Mr. Fleming represented boxing promoter Don King in the defense of a criminal indictment alleging insurance and wire fraud brought by the U.S. Attorney for the Southern District of New York, which resulted in a “not guilty” verdict after a three and one-half month trial.
In addition to handling litigation matters for clients of the Firm, Mr. Fleming has developed an extensive barrister practice in both civil and criminal areas. He has been lead counsel for the defense of several major white-collar criminal prosecutions of individuals and corporations, including, most recently, John Rigas of Adelphia Communications. Among other civil matters, Mr. Fleming has represented Jardine Matheson Holdings, Limited in connection with its aborted tender for a minority interest in Bear Stears and Allegheny Ludlum Corporation and its Chief Executive Officer against a claim by two former executives that they had been misled in connection with a future initial public offering of Allegheny Ludlum stock.
Mr. Fleming is admitted to the courts of the State of New York; U.S. District Courts both of the Southern and Eastern Districts of New York; Court of Appeals, both the Second and Fourth Circuits, and the U.S. Supreme Court. Mr. Fleming is AV rated in Martindale-Hubbell.
