Mr. Behmke is a partner in the Litigation group.  He has extensive experience in a full range of commercial and business-related litigation throughout the United States and internationally.  His practice has included significant matters involving complex financial contracts, valuation and lender disputes, accounting and auditing, structured and derivative financial products, commercial contracts, commodities, securities, energy projects, executive employment disputes, fraud and a variety of other commercial and business torts.

He has represented companies and individuals in state and federal courts at the trial and appellate level, as well as before the Securities and Exchange Commission (SEC), Financial Industry Regulatory Authority (FINRA), and the Department of Justice (DOJ). Among other representations, Mr. Behmke was a member of the trial team in the defense of a former “big five” international accounting firm in one of the largest securities class actions in the United States.  Mr. Behmke also has experience in domestic and international commercial arbitration matters, including representation of clients in arbitration hearings conducted under the auspices of the American Arbitration Association (AAA), International Centre for Dispute Resolution (ICDR), the International Chamber of Commerce (ICC), and the CPR Institute.

Mr. Behmke is also well versed in bankruptcy litigation, having successfully prosecuted and defended claims brought by creditors, debtors and other stakeholders in a number of large bankruptcy matters.  Most recently, Mr. Behmke represented the estate of Lehman Brothers in two multi-billion dollar adversary proceedings against creditors of the bankrupt firm, initially as a team member and later as Curtis’ lead litigation counsel.  Those litigations resulted in court-approved settlements by which over ten billion dollars of assets were returned to the Lehman Brothers estate for distribution to creditors.
