Curtis was featured on Law360.com in an article entitled "Silicon Graphics, Samsung Settle Bankruptcy Appeal" published on August 27, 2008. The article named Curtis as counsel to Silicon Graphics Inc. in an appeal filed by Samsung Electronics Co. Ltd.'s of an order entered by the Bankruptcy Court in favor of the debtor, Silicon Graphics. The key issue on appeal was whether the debtors had assigned certain dynamic random access memory ("DRAM") price-fixing claims to the DRAM liquidating trust pursuant to the terms of the plan of reorganization and liquidating trust agreement. Samsung argued that the DRAM claims at issue were not part of the debtors' original assignment because of an alleged date limitation and that the trustee of the liquidating trust was therefore precluded from asserting those claims against Samsung in a DRAM litigation in the United States District Court for the Northern District of California. Silicon Graphics maintained that the liquidating trust assets were comprised with DRAM claims that arose prior to the alleged date limitation and furthermore that Samsung had no standing to object. On August 26, 2008, the appeal was dismissed pursuant to a stipulation entered into by the parties and approved by United States District Court Judge Loretta Preska. Curtis partners Lynn Harrison 3d and Turner Smith, and associate Stefanie Beyer worked on the matter.
