Court Grants Recognition to Canadian Proceeding of The Tall Girl Shops
New York, November 2, 2009 – On October 22, 2009, Chief Judge Stuart M. Bernstein of the United States Bankruptcy Court for the Southern District of New York granted recognition under Chapter 15 of the U.S. Bankruptcy Code to the Canadian insolvency proceeding of The Tall Girl Shops Ltd. Chief Judge Bernstein also recognized Curtis, Mallet-Prevost, Colt & Mosle LLP client A. Farber & Partners Inc. in its capacity as proposal trustee and interim receiver to the debtor. In addition, both Farber and Tall Girl were authorized to conduct store closing sales in the 17 Tall Girl locations throughout the United States. It is believed this is the first time store closing sales have been authorized under Chapter 15 of the U.S. Bankruptcy Code. An affiliate of Hilco Merchant Resources LLC is conducting the sales.
Tall Girl is a privately held company incorporated in the Province of Ontario that operates a specialty retail clothing chain serving the needs of tall women. Tall Girl currently operates 14 stores in Canada and 17 stores in the United States.
