Curtis Represents Creditor Plan Proponents in MF Global Holdings Bankruptcy Case

Attorneys from Curtis, Mallet-Prevost, Colt & Mosle LLP served as conflicts counsel to a group of Creditor Plan Proponents in the Chapter 11 bankruptcy case of MF Global Holdings Ltd. in the United States Bankruptcy Court for the Southern District of New York.

The Creditor Plan Proponents included Barclays Capital, Citigroup, BlueMountain, Deutsche Bank, The Royal Bank of Scotland, Serengeti, and Silver Point, among others. Jones Day served as lead counsel.

Curtis was responsible for all matters in which the Creditor Plan Proponents were adverse to JPMorgan Chase Bank, N.A., including offensive and defensive discovery and mediation to settle issues with respect to JPMorgan.  The successful results achieved during the JPMorgan meditation allowed the MF Global Chapter 11 plan of liquidation to move forward on a consensual basis, which plan was approved by the Bankruptcy Court on April 5, 2013.

The Curtis team of lawyers advising the Creditor Plan Proponents was led by partner Steven J. Reisman and associate Cindi M. Giglio from the firm’s Restructuring and Insolvency group, and partners Turner P. Smith and Michael J. Moscato and associate Kevin Meehan from the Litigation practice.

Curtis’ Restructuring and Insolvency group regularly advises debtors, creditors’ committees, secured and unsecured creditors, financial institutions, equity owners and investors, trustees, liquidators and court-appointed fiduciaries, and foreign and domestic governmental agencies in all facets of restructuring and insolvency matters both in and out of court.  Curtis has developed a national reputation as the leading law firm in “conflicts counsel” engagements in large and complex Chapter 11 restructurings on both the debtor and creditors’ committee sides.
