Gabriel Hertzberg is an experienced New York litigator with a practice focusing on complex commercial disputes, debtor-creditor litigation, and government, regulatory and internal investigations. He appears in state and federal courts throughout the United States, and has advised business owners, executives and corporate boards in many countries throughout the world.
Mr. Hertzberg has particular experience in the hedge fund, insurance and financial services sectors, and in disputes between investors and investment managers. He often handles disputes involving allegations of fraud and fraudulent transfer, breach of fiduciary duty by officers and directors, and breach of contract in a wide range of industries. Mr. Hertzberg has significant experience in arbitrations before AAA and JAMS, and in the recognition and enforcement of arbitral awards in the U.S. courts.
Mr. Hertzberg also represents targets, subjects and witnesses in government and regulatory investigations. He handles matters brought by the United States and its agencies, including the U.S. Attorneys’ Offices and the Securities and Exchange Commission.
Prior to joining Curtis, Mr. Hertzberg was an assistant attorney general for the State of New York, where he represented the state in enforcement proceedings and civil rights litigation.
Awarded 'Best Brief of 2007' (with T. Barry Kingham and Turner P. Smith) by New York State Bar Association, Commercial and Federal Litigation Section, for a brief submitted to the Second Circuit Court of Appeals on behalf of Fédération Internationale de Football Association (FIFA).
