Michael J. Moscato

Senior Counsel

Michael Moscato is a senior counsel in the Litigation group. He is an experienced trial lawyer whose practice focuses on complex litigation, including class action defense, bankruptcy litigation, professional malpractice, securities fraud, and white-collar criminal defense.

Mr. Moscato has represented issuers, hedge fund administrators, auditors, and corporate officers in numerous shareholder class actions and group actions. He was co-lead trial counsel for an international accounting firm in the WorldCom securities class action before the Honorable Denise Cote of the Southern District of New York. Mr. Moscato also helped spearhead the spoliation motions that led to the highly influential Zubulake Revisited Six Years Later decision by the Honorable Shira Scheindlin. He has represented clients in investigations and proceedings conducted by the Securities and Exchange Commission (SEC), the Public Company Accounting Oversight Board (PCAOB), and state accounting boards. Mr. Moscato has also been involved in high-profile bankruptcy litigations, representing debtors in adversary proceedings and claims objections.

Prior to joining Curtis, Mr. Moscato was a Senior Staff Attorney at the Legal Aid Society, Criminal Defense Division, where he conducted numerous felony jury trials.
