Nancy Delaney focuses her practice on civil jury and non-jury cases in federal and state courts, as well as on representing clients before regulatory bodies in contested proceedings and litigating of disputes in a variety of arbitral and industry forums.

Litigation

A seasoned litigator, Ms. Delaney has a track record of success in complex commercial litigations, and in prominent securities and white-collar investigations. She recently led the Curtis team in a securities arbitration case described as the “biggest individual fraud perpetrated on small investors in the UK” by the Financial Times. Curtis was successful in obtaining a comprehensive international arbitration award (with indemnification damages and attorney’s fee) for its client, CRT Capital Group, and in obtaining the subsequent award confirmation in the U.S. District Court for the Southern District of New York. Ms. Delaney also represented the Estate of Lehman Brothers Holdings, Inc. in the adversary proceeding against JPMorgan.

She has substantial experience representing private and high-net-worth clients in contested matters.

Securities and Commercial Arbitration

Ms. Delaney has represented several clients, including broker-dealers, in arbitrations before the Financial Industry Regulatory Authority (FINRA). She has also acted as counsel for state-owned entities and international organizations, as well as publicly and privately held companies, in American Arbitration Association (AAA) and United Nations Commission on International Trade Law (UNCITRAL) arbitrations.

Government Investigations

Ms. Delaney has counseled individuals and corporations in investigations initiated by the Securities and Exchange Commission (SEC). In a notable matter, Ms. Delaney represented a U.S. financial company in an SEC investigation arising out of Chinese company reverse mergers on U.S. stock exchanges. She led a team to gather and review company documents, prepare and represent witnesses in SEC interviews, and then submitted a white paper marshalling the law and the facts. The SEC declined to recommend any enforcement action against the company or its managing director.

Thought Leadership Initiatives including Diversity and Inclusion

Ms. Delaney spearheaded the firm’s efforts to develop a CLE training session titled “Implicit Bias in the Legal Profession,” which is geared towards sensitizing and eliminating prevalent biases in the legal profession, in compliance with the New York State CLE Board’s required category of credit in Diversity, Inclusion and Elimination of Bias. She also leads a monthly development and training program, Women’s Initiative, to promote and support gender diversity within the firm.
