Law360 Quotes Michael Graif on Supreme Court Trademark Ruling


Michael Graif, chair of Curtis’ Intellectual Property group, was quoted by Law360 on the significance of theU.S. Supreme Court’s B&B Hardware Inc. v. Hargis Industries Inc. ruling that federal court decisions on “likelihood of confusion” can be precluded by earlier rulings on the same issue from the Trademark Trial and Appeal Board. Mr. Graif said that, as a result of the decision, he expects “we will see more appeals of TTAB rulings by unsuccessful trademark applicants who may have thought that they could use the mark anyway and re-litigate likelihood of confusion if they were ever sued for infringement.”
