Curtis Files Chapter 15 Bankruptcy Case on Behalf of The Tall Girl Shops

New York, October 19, 2009 ­­– On September 30, 2009, Curtis acted on behalf of client A. Farber & Partners Inc., in its capacity as proposal trustee and interim receiver of debtor The Tall Girl Shops Ltd., in filing a voluntary petition under Chapter 15 of the Bankruptcy Code on behalf of the debtor and requesting related relief.

In the Chapter 15 case, Farber is seeking recognition that the debtor’s foreign insolvency proceeding pending in the Superior Court of Justice of the Province of Ontario, District of Toronto (Commercial Division), is a foreign main proceeding and that Farber is the foreign representative of the debtor. If accepted, the US Bankruptcy Court would recognize the Canadian proceedings and adhere to its decisions. On October 1, 2009, Chief Judge Bernstein of the United States Bankruptcy Court for the Southern District of New York provided the debtor with provisional and related relief in the Chapter 15 case, and scheduled a hearing to consider the request for recognition. The hearing will be held on October 22, 2009.

Tall Girl is a privately held company incorporated in the Province of Ontario that operates a specialty retail clothing chain serving tall women. Tall Girl currently operates 14 stores in Canada and 17 stores in the United States. Tall Girl’s United States stores are being liquidated by an affiliate of Hilco Merchant Resources, LLC.
