Simon Batifort Speaks at 4th OECD Conference on Investment Treaties

Simon Batifort, Counsel in the International Arbitration Group in New York, spoke at the 4th OECD Conference on Investment Treaties on March 12, 2018. His panel explored whether investment treaties should limit the ability of investors to use Most-Favored-Nation clauses for purposes of “treaty-shopping,” and whether they should limit the ability of investors to claim compensation for reflective loss incurred by their subsidiaries. His co-panelists included Professor Rob Howse (NYU Law), Shane Spelliscy (Canada’s Trade Law Bureau), Professor Stephan Schill (University of Amsterdam), Professor Felix Steffek (University of Cambridge) and Jorun Baumgartner (UNCTAD). The conference was attended by senior treaty policy makers, treaty negotiators and representatives from international organizations.
