Partner Steven Reisman was invited to speak with the Honorable Burton R. Lifland, United States Bankruptcy Judge for the Southern District of New York (the Judge presiding over the Madoff bankruptcy and SIPA proceedings), and other esteemed panelists on “SIPA Liquidations and Ponzi Schemes” at the American Bankruptcy Institute’s 12th Annual New York City Bankruptcy Conference on May 24, 2010. The panel addressed the developing law on fraudulent conveyance actions in recent and ongoing Ponzi scheme bankruptcy litigation matters, as well as the applicability of the Securities Investor Protection Act of 1970 (“SIPA”) in broker-dealer insolvency proceedings and, in particular, the Lehman Brothers Inc. SIPA liquidation. The discussion centered around the applicability of the “good faith” defense to a fraudulent conveyance action and the calculation of customer and investor claims in SIPA liquidations and Ponzi scheme insolvency proceedings.
