Four Curtis attorneys were featured in new reports recently published by the Insolvency and Arbitration Working Group of the IBA Arbitration Committee.
As co-chair of the Working Group, Partner Simon Batifort (New York & Brussels) co-led the elaboration of both reports, namely the new IBA Report on Insolvency and Investment Arbitration and the second edition of the IBA Toolkit on Insolvency and Arbitration. The Report on Insolvency and Investment Arbitration provides the first comprehensive treatment of the intersection between insolvency and investment arbitration and includes seven chapters authored by leading arbitration practitioners. The Toolkit provides guidance to parties, counsel and arbitrators in situations where a party to arbitration proceedings is also subject to insolvency proceedings in one or more jurisdictions, and features national reports from 26 jurisdictions.
Partner Justin Jacinto (Washington, D.C.) and Associate Charlotte Fromont (Paris) co-authored the chapter on the “Merits” of the Report on Insolvency and Investment Arbitration. Partner Ricardo Mier y Teran Ruesga (Mexico City) co-authored the national report for Mexico of the Toolkit on Insolvency and Arbitration.
