Curtis' construction law practice advises on the full range of contractual and legal matters in relation to large and complex international and domestic construction, engineering and infrastructure projects in the role of project counsel. This can begin at the tendering stage and progress throughout the lifetime of a project in relation to dispute avoidance and dispute resolution.
Our clients act as project sponsors, investors, lenders, developers and state entities in major construction projects, and operate in a wide array of sectors, including power (hydro, gas, LNG, wind and geothermal); water and wastewater; petroleum and petrochemicals; transportation (airports and ports, maritime, railroads, toll roads, etc); mining and telecommunications.
Curtis construction law attorneys have represented state-owned companies, investors, developers and contractors in the preparation of contracts and project documents, including AIA-based forms, FIDIC contracts and in the development of tenders for infrastructure projects. They are also well prepared to address issues that inevitably arise during infrastructure projects, including financing, environmental and tax issues.
In our experience, investing in legal advice prior to contract execution is money well spent by a contractor, as it invariably avoids the future greater costs of dispute resolution with respect to an unclear or incompletely drafted contract.
Our infrastructure development practice counsels clients worldwide on the full range of corporate, financial and regulatory issues affecting their respective industries.
The practice handles a broad range of domestic and international transactions, including some of the world's largest and best known project finance transactions and projects in the international petroleum and power industries. The latter takes the form of build, lease and transfer (BLT), build, own and operate (BOO), build, own, operate and transfer (BOOT), or adaptations of the foregoing, particularly in light of local legal requirements.
Curtis has a specialism in construction disputes, particularly within our international arbitration team which offers considerable experience in mediation, as well as in dispute resolution under the AAA, ICC, and ad hoc rules. We have an excellent track record in representing governments and state entities as defendants in arbitrations in the construction industry arising under both contractual and investment law.
Curtis has advised countries and international entities on construction law. Attorneys in our Middle East offices in particular have considerable experience in advising both international and local contractors in relation to the drafting of their construction contracts, prior to project commencement. We are very familiar with FIDIC standard form contracts and other industry standard form contracts, including with respect to electrical and mechanical works, building and civil engineering works or on a design/build, DBO or EPC basis.
Where appropriate, Curtis can place experienced members of the team on site to advise on and assist in matters which are building up to a dispute or to advise on options and strategies for dealing with historical disputes.
