Simon Batifort and Andrew Larkin Publish “The Meaning of Silence in Investment Treaties” in the ICSID Review

Simon Batifort, Partner in the International Arbitration and Public International Law Groups based in New York, Paris, and Brussels, and Andrew Larkin, associate in the Litigation and International Arbitration Groups based in New York, have published a new article on “The Meaning of Silence in Investment Treaties” in the ICSID Review-Foreign Investment Law Journal. The article is available here and can be freely accessed for a limited time. The authors previously presented the article at the 2020 Midyear Meeting of the American Society of International Law (ASIL), the 2021 Works-in-Progress Workshop of the ASIL International Courts and Tribunals Interest Group, the 2021 Annual Meeting of the European Society of International Law, and the 7th Biennial Global Conference of the Society of International Economic Law.
