Schwartz and Jonathan Byer published an article, “Decanting and Compulsory Accounting Under New York Law,” in the April 11 issue of The New York Law Journal. The authors review the recent clarifying amendments to the New York decanting statute, with specific focus on the six-year statute of limitations for a beneficiary to compel a trustee to account. The article further analyzes when a potential trust decanting may cause the statute of limitations to run in various scenarios.
