Curtis partner Don Hawthorne, along with associates Grace Condro and Kaitlyn Kocharian, has published an article in Law360 titled "NY Laundering Ruling Leans on Jurisdictional Fundamentals." The article discusses far-reaching and unsettled issues involving the jurisdiction of US courts to hear foreign disputes.
Recently, New York courts have become increasingly willing to adjudicate foreign civil disputes on the basis that proceeds from alleged foreign misconduct have been laundered into high-end New York real estate. That basis for jurisdiction could in principle be very far-reaching; it justifies a New York court and jury hearing cases involving foreign parties and foreign conduct decided under foreign law, with minimal connection to New York than any judgement enforcement proceeding.
The article uses a series of cases to explore this principle, including one in which the Curtis team was directly involved.
