Antonio M. Prida to Speak on Mediation Reforms at Mexican Bar Commission Meeting

The founding partner of the Curtis Mexico City office, Antonio M. Prida, will be a keynote speaker in a meeting of the Mediation and Collaborative Law Commission of the Mexican Bar to be celebrated on March 19, together with the participation of the Mediation Commission of the Ilustre y Nacional Colegio de Abogados which he coordinates.

Mr. Prida’s presentation will include an analysis of a proposed Constitutional Reform which may include the use of Mediation as an admissibility requirement, before having access to Court. He will also analyze a similar Legal Reform at the level of the National Code of Civil and Family Procedures.

The presentation by Mr. Prida and his Mediator colleague Oscar H. Morales, will include the analysis of a recent Resolution of the Supreme Court of Justice recognizing that in Mexico coexist a double regime for Mediation: a Mediation certified by the Judiciary, with the effect that the Mediation Agreements reached by the parties are considered as “res judicata”, and a free Mediation regime regulated by ordinary law.

Finally, the audience will be benefited by the analysis of the Resolution of the International Union of Lawyers (UIA) on Prevention and Resolution of Conflicts, adopted last November during the annual Congress held in Guadalajara, Mexico. Such Resolution includes a call to States, National Bar Associations and lawyers of the world, to consider the use of Mediation as an ethical obligation.
