Commercial Litigation and Arbitration

As counsel to multinational corporations in numerous international commercial arbitrations, and a well-practiced Solicitor Advocate, Mr. Molfa has experience in the world’s most frequently selected arbitral seats, including Geneva, Hong Kong, London, Milan, New York, Paris, Singapore, Stockholm, The Hague, and Zurich. He regularly advises on and appears before arbitral tribunals constituted under the rules of the leading institutional and ad hoc arbitration regimes, including the American Arbitration Association (AAA), the Chamber of Arbitration of Milan (CAM), the Hong Kong International Arbitration Centre (HKIAC), the International Centre for Settlement of Investment Disputes (ICSID), the International Chamber of Commerce (ICC), the London Court of International Arbitration (LCIA), the Singapore International Arbitration Centre (SIAC), the Swiss Chambers’ Arbitration Institution (SCAI), the Arbitration Institute of the Stockholm Chamber of Commerce (SCC), and UNCITRAL. His transnational litigation and arbitration experience spans a range of industries, including airlines, aviation and aerospace, automotive, energy, media and advertising, metals and mining, and oil and gas.

Mr. Molfa has acted as counsel and advocate in disputes arising out of M&A, joint venture and shareholders’ agreements, technology transfer agreements, licensing and distribution agreements, media rights agreements, engineering, procurement, construction and commissioning contracts, and long-term gas supply agreements governed by the substantive laws of many civil and common law jurisdictions, including the laws of Austria, Brazil, California, the Czech Republic, England, France, Germany, Greece, Hong Kong, Italy, New York, the PRC, the Russian Federation, Singapore, Sweden, Switzerland, as well as the UNIDROIT Principles.

Enforcement Proceedings

Mr. Molfa also routinely advises on cross-border enforcement of arbitral awards and set aside proceedings as well as on multijurisdictional aspects of European civil and commercial litigation, including recognition and enforcement of judgments under the Brussels regimes and the common law.

Public International Law

In public international law, clients benefit from Mr. Molfa’s substantial experience in multilateral and bilateral investment treaty-based arbitrations, which includes representing the Russian Federation in various investment-treaty arbitrations ensuing from the demise of Yukos Oil Company.

Italian Companies

Bilingual and dual-qualified in both Italy and England & Wales, much of Mr. Molfa’s practice has an Italian focus. He regularly advises clients in Italy on Italian and English law matters and acts for Italian multinational corporations around the globe.

Mr. Molfa is a member of the Arbitration and ADR Committee of ICC UK and in 2020 was appointed to the ICC Commission’s Task Force on ADR and Arbitration. He is the author and the co-author of two treatises and several other publications and regularly lectures and speaks at conferences on international arbitration matters.
