Partner Elisa Botero, head of the firm’s cryptocurrency, digital assets and blockchain law group, and white-collar litigation associate Kaitlyn Devenyns have been quoted in a CoinDesk article entitled, “Will SBF’s ‘Blame-the-Lawyers’ Strategy Work?” The article focuses on FTX Trading Ltd. founder Sam Bankman-Fried’s (SBF) legal strategy ahead of his criminal trial in October. Ms. Botero and Ms. Devenyns said SBF may have difficulty getting hold of the documents it needs to show that SBF acted on outside advice.
"If he’s not able to get the physical documents, it raises the question of how he will be able to prove that he received advice from counsel and that he relied on it. This is where witness testimony may come into play,” said Ms. Devenyns.
Moreover, SBF has to show that he read and acted on the advice. "Even if SBF can get the evidence he wants, he still needs to establish that he actually read or received the advice before he can claim that he acted on it," said Ms. Botero.
