Andrew Larkin Speaks at the 2023 ASIL Midyear Meeting

Associate Andrew Larkin recently presented at the 2023 ASIL Midyear Meeting Research Forum on November 10 in Pittsburgh. As part of a panel on “International Economic Law,” Mr. Larkin presented his paper “Vested Rights, Incomplete Licenses, and the Emerging International Law of Property”. The work in progress critically examines how investment treaty awards disrupt core regulatory features of State licensing laws governing mineral resources. As illustrated in the controversial recent Rockhopper v. Italy award, these conceptual tensions can pose significant practical problems for States seeking to take environmental measures such as restricting fossil fuel development.
