Partner Vic Zimmermann and associate Mark Conrad published an article, “FINRA’s New Capital Acquisition Broker Rules May Provide New Business Opportunities” in the December 19 edition of Bloomberg BNA’s Securities Regulation & Law Report.
The article addresses the ramifications of the Financial Industry Regulatory Authority’s (FINRA)’s new Capital Acquisition Regime (CAB Rule 221) for the broker-dealer industry. Messrs. Zimmermann and Conrad write that the new FINRA regime should facilitate the increased use of broker-dealers to market investment funds. They also write that, by allowing for predictions or projections of performance, the new FINRA regime will provide institutional investors with more information about the intended strategy so that they may better analyze and assess the risks.
