London counsel Lise Johnson made a presentation on “Climate-related Litigation in ISDS” to the Organisation for Economic Co-operation and Development (OECD) on April 12, 2022. The presentation provided investment policy makers with background information on climate-related litigation to give them a better understanding of recent developments and how they may be relevant to the future of investment treaties.
In her presentation, Ms. Johnson explained how current and potential bases for ISDS challenges to climate policies are often broader than under some domestic law systems, and how ISDS enables investors to pursue a wide range of claims relating to climate legislation.
