Curtis Secures Decisive Win for Republic of Indonesia in ICSID Annulment Proceedings

On March 18, 2019, an ICSID annulment committee denied the entire request by Churchill Mining Plc and Planet Mining Pty Ltd for annulment of the 2016 Award which saw the mining companies’ US$1.31 billion claims against the Republic of Indonesia dismissed as inadmissible, with costs and expenses in the underlying arbitration awarded to the State in the amount of US$9.4 million. The Curtis team, led by partner Claudia Frutos-Peterson and senior counsel Mark O’Donoghue, and including partner Kevin Meehan and counsel Marat Umerov, represented the Republic of Indonesia in the ICSID proceedings.
